The right perspective on 1963 Federation
Ignoring Sept 16 is yet another example of how Putrajaya alienates the people of Sabah and Sarawak and caused ill-feelings among them.
KUALA LUMPUR: Two leaders from Sabah and Sarawak, one from the Opposition and another from the ruling Barisan Nasional (BN), found common ground on the Sept 16, 1963 Federation of Sabah and Sarawak with the peninsula.
Sarawak Minister of Land Development James Masing and Penampang MP Darell Leiking told a book launch at a university in Petaling Jaya on Fri that the celebration of the independence of the peninsula on 31 Aug, 1957 should not take precedence over Malaysia Day. Sarawak became independent on July 22 and Sabah on Aug 31, both in 1963 just weeks before Malaysia on 16 Sept, 1963.
“If Aug 31 (Independence Day of the peninsula) is made (within the national context) a more important date than Sept 16, it would worsen already strained ties between Sabah/Sarawak and the peninsula,” warned the duo.
“It could only heighten the anger of Sabahans and Sarawakians, who already feel that they are being robbed of development funds by Putrajaya despite billions in oil revenue from the two states.”
They noted that Sept 16, unlike Aug 31, was not a public holiday until 2010 shortly after
Prime
Minister Najib Abdul Razak assumed office.
“We came a long way, i.e. 47 years, to get the date 16 Sept 1963 recognised as the birthday of Malaysia,” said James.
Ignoring Sept 16, reiterated the duo, is yet another example of how Putrajaya alienates the people of Sabah and Sarawak and caused ill-feelings among them.
“Our school textbooks and our songs also do not teach the right facts. There was no Malaysia before 1963,” fumed James. “Even my children won’t believe me.”
Darrel, echoed by James, reiterated his call for the review of the Malaysia Agreement 1963 (MA63) which was supposed to be held in 1973.
Borneo not destructive and politicians should not kill the messenger
He refuted accusations that calling for a review of MA63 meant that a secession movement was brewing in Sabah.
“The expression of dissatisfaction on the part of Sabahans cannot be regarded as a movement for secession,” said Darell. “This is about the treatment of Sabah by the federal government.”
James pleaded that “these are positive criticisms, so we could look into solving the problem. These dissatisfactions of the people of Borneo are not destructive and politicians should not kill the messenger”.
The book titled, 50 Years of Malaysia: Federalism Revisited, was co-authored by James Chin of Monash University Malaysia and Andrew Harding of National University of Singapore, with James Masing being among the contributors.

Facebook reflects the people’s aspirations
Jeffrey implies Salleh to blame for East Malaysian activists turning to the UN regarding the issue of decolonisation in Borneo.
KOTA KINABALU: The quiet revolution taking place in the social media, Facebook in particular, is a reflection of the people’s aspirations on the way forward in Borneo after half a century of Federation with the peninsula on the other side of the South China Sea.
That’s the thesis statement in a five-page release by Jeffrey Kitingan expressing outrage on Sabah Speaker Salleh Keruak calling on the authorities to act firmly against those demanding in the social media for Sabah to exit the Federation with the peninsula.
Jeffrey, among others the state assemblyman for Bingkor, implied that he could not believe that the Speaker was using the people’s legitimate aspirations as an excuse to please his political masters in the peninsula and further his political career in the process.
“Salleh is just following the old dictatorial ways and threatening the people instead of listening and addressing the issues raised by them,” said Jeffrey, also Star Sabah chairman. “Salleh is playing politics, playing one upmanship, against his competitors for the Chief Minister’s post.”
Jeffrey expressed surprise that Salleh, as a Sabahan, does not seem to care about “the concerns of the people and the injustices suffered by them” as a result of the way that the Federation has turned out to be since 1963.
He urged that “leaders should listen more and understand the voices of dissension and unhappiness and not jump to conclusions”.
Jeffrey implied that Salleh was to blame for activists in Sabah and Sarawak turning to the United Nations (UN) to bring closure on the unfinished business of decolonisation in Borneo.
“I have personally raised the issue in the Sabah Assembly but it was not allowed,” said Jeffrey in reminding Salleh of his role as the Speaker in the incident.
Correct the manipulation of facts and history, not condone it
Dismissing Salleh’s concerns, the Star Sabah Chief explained that the People’s Petition which is now making its way in both Borneo Nations to collect a minimum 300,000 signatures was unfinished business from 1962 when a similar petition before the UN was allegedly sabotaged by the British when the Brunei Rebellion broke out.
He called on everybody, including Salleh in particular, to help make known the true story of the last half century which has been emerging in Facebook since the 50th year of the Sabah, Sarawak Federation with the peninsula. “Salleh should take steps to help correct the manipulation of facts and history, not condone it,” urged Jeffrey. “Let the truth and facts be put correctly.”
Jeffrey stopped short of calling on Salleh to participate in several events planned between now and the run-up to Malaysia Day on Sept 16: Merdeka Walk on Aug 27 from Kudat, Ranau and Keningau to Kota Kinabalu and culminating in an Independence Walk on Aug 31 at the world-famous Tanjung Aru beach in the Sabah capital; a Merdeka Convoy from Ranau to Kundasang on Sept 5; a Love Malaysia Parade in Ranau on Sept 6, a Malaysia Day Commemoration at Batu Sumpah, Keningau on Sept 16; and a Malaysia Day Convoy from Keningau to meet a similar convoy from Sarawak at Limbang.

Emphasis on August 31 unfair to Sabah and Sarawak, say leaders
With only eight days to go before the 57th Merdeka celebrations, two politicians from Sabah and Sarawak have criticised Putrajaya for putting too much emphasis on August 31.
Sarawak minister Tan Sri Dr James Masing (pic) and the MP for Penampang in Sabah Darell Leiking told a forum today at Sunway University in Petaling Jaya that making August 31 a more important date than September 16 would worsen already strained ties between Sabah and Sarawak, and the peninsula.
They argued that Malaysia only came into being on September 16, 1963, whereas August 31 marked the date when 11 Malay states gained their independence from the British.
Continuing to harp on the importance of August 31 instead of September 16, they said, would only heighten the anger of Sabahans and Sarawakians, who already feel that they are being robbed of development funds by Putrajaya.
Until 2004, September 16 has never been a public holiday, unlike August 31. The latter has traditionally been given greater prominence by the Barisan Nasional federal government.
The bigger significance given to August 31 has always caused ill-feelings among Malaysians from Sabah and Sarawak, who believe it is yet another example of how Putrajaya alienates them.
They have long complained that Sarawak and Sabah do not get enough development funds despite the fact it provides billions to Putrajaya through the sale of its petroleum.
Leaders from Sarawak and Sabah also claimed that successive Prime Ministers from the peninsula-based Umno party have breached the 20 and 18-point agreements signed between Malaya and Sabah and Sarawak in 1963.
The agreements lay out vast powers of autonomy that give Sarawak and Sabah rights to self-manage among others, their civil service, finances and relations between the scores of indigenous tribes.
Masing, the Parti Rakyat Sarawak president, said Sarawakians in their 50s and 60s are still upset that Putrajaya teaches their children that August 31 is Malaysia’s independence day.
“Even my children are given the wrong idea. I tell them Malaysia came into being on September 16. They won’t believe me and say it is August 31,” said Masing, who is Sarawak minister of Land Development.
“Our school textbooks and our songs also do not teach the right facts. There is no Malaysia before 1963.”
Masing was speaking at a forum at the book launch of “50 Years of Malaysia, Federalism Revisited”.
The book is a collection of essays experience of Singapore, Sabah and Sarawak as subjects of the Malaysian federation and the state of relations between them now.
The book launch and forum was organised Sunway University and the Jeffrey Cheah Foundation.
Leiking, who is from Sabah PKR, said that the huge celebrations on August 31 were to benefit a certain a political movement rather than marking an important date in the nation’s history.
“August 31 is a wrong date and many are unhappy with it. It is only to appease a certain political movement.
“I agree that we should only talk about Malaysia from September 16, 1963. The agreements make this clear”. – August 22, 2014.

Do Sabah and Sarawak really want to leave Malaysia?
Two prominent East Malaysian politicians have attempted to play down the desire expressed by some people for Sabah and Sarawak to leave Malaysia, but an academic and expert on the subject says the sentiment is fuelling an actual movement 51 years after the country was formed.
The politicians, Sarawak Minister of Land Development Tan Sri Dr James Masing and Sabah federal lawmaker Darell Leiking, claimed that the desire was more of a sentiment rather than an actual movement.
Leiking, who is Penampang MP, said the desire among young Sabahans for Sabah to secede is an accumulation of anger at how they have been treated by the Peninsula-based federal government.
However, Prof James Chin, an expert on relations between East and West Malaysia, believes that the movement to secede is real. However, it disguises itself because secession is treason under Malaysian law.
The fact that the sentiment is strong but can only be expressed through social media and away from official scrutiny also makes it difficult to tell whether it will have any electoral impact, said Chin.
“Today young Sabahans are saying let’s look at the agreements again. What they really want is a review of the Malaysia agreement,” Leiking, told a forum at a book launch of “50 Years of Malaysia: Federalism Revisited”.
“I think it is good because it shows an awareness among the young about the state of Sabah,” said Leiking.
“It will continue until Putrajaya decides to review the agreement,” he told an audience at the forum which was held at Sunway University, in Petaling Jaya.
This desire to break away from the 50 year-old federation among East Malaysians has mostly been expressed on the Internet and through social media groups such as SSKM (Sabah Sarawak Leave Malaysia).
But academics and East Malaysian groups have in the past admitted that the sentiment is real especially among the younger generation.
A Malaysian Insider straw poll done in the last week of July among 100 East Malaysians also showed that the largest number of those surveyed, or 43%, felt that Sarawak and Sabah could only solve their problems by leaving the federation.
The poll among both rural and urban East Malaysians found that more Sarawakians wanted secession compared to Sabahans.
Autonomy to self-govern was the second most preferred choice among Sabahans in the straw poll. The first choice was to work together with the current government to solve Sabah’s problems.
A main source of anger is the believe that successive Prime Ministers from Peninsula-based Umno have not fulfilled the terms of the 20 and 18-point agreements which Sabah and Sarawak signed.
These agreements allowed Sabah and Sarawak more freedom in managing state finances, the civil service and education among others.
Other East Malaysian leaders and scholars have said this deal was what persuaded the then leaders of Sabah and Sarawak to agree to form Malaysia together with Singapore and Malaya.
East Malaysians have long complained that Sarawak and Sabah do not get enough development funds despite the fact that it provides billions to Putrajaya through the sale of its petroleum.
However, Masing, who is the Parti Rakyat Sarawak president, told the forum that the sentiment was not as strong among Sarawakians compared to Sabahans.
“They want a review of the agreements but I am more moderate and would ask that we revisit them.
“If there are promises which have not been fulfilled, then let’s fulfil them,” Masing told The Malaysian Insider when met after the forum.
Leiking also told The Malaysian Insider that the threat of secession was not as bad as it seemed.
“I hear this (sentiment to secede) everyday in Sabah. But I believe it is really a desire for more autonomy and decentralisation.
“It’s a divorce. The couple may be so angry at each other that they think, let’s just end this. But there is always the option to reconcile instead of breaking up”.
Chin, of Monash University Malaysia, however claimed that there was actual grassroots work in Sabah and Sarawak to channel this anger into concrete action.
This included an online campaign to collect signatures for a petition to the United Nations and a plan to bring a law suit against the United Kingdom.
The principle behind the lawsuit against the UK government is that Britain had bungled the process of overseeing the merger in the 1960s and this had impacted the future of Sabahans and Sarawakians, said Chin.
“It’s the same as the Hindraf (Hindu Rights Action Front) law suit against the UK government,” said Chin.
That suit claimed Britain did not provide enough safeguards to ensure that the minority Indian community would be adequately taken care of by the new Malayan government.
Besides the lawsuits, however, it is still unclear how much of an impact this anger makes in an election.
“You cannot really gauge it because no political party can come out and campaign for secession. It’s against the law.
“But there is a gut feeling among young Sabahans and Sarawakians that the federation experiment has failed them.” – August 23, 2014.

Sabah, Sarawak activists petition the UN
The Petition on Self-Determination is expected to gather several hundred thousand signatures in Sabah and Sarawak before making its way to the UN Secretary General.
MIRI: Sabah, Sarawak activists, NGOs and politicians, have drawn up a Petition, addressed to the UN Secretary-General, on re-visiting the self-determination issue for Sabah and Sarawak.
The Petition is being copied to the UN Special Committee of 24 (C-24), or Decolonization Committee, and the UN Human Rights Committee.
The Petition, signed in Miri over the weekend by about 100 participants is expected to gather several hundred thousand signatures in Sabah and Sarawak before making its way to the UN Secretary General.
“It’s obvious from Article 160 of the Federal Constitution that Malaysia was not formed as was earlier promoted by the British and Malayan Governments,” said Daniel John Jambun, the President of the UK-based Borneo’s Plight in Malaysia (BoPIM) in explaining why he signed the Petition.
“Sabah and Sarawak were dragged into the Malayan Federation on 16 Sept 1963 by the British and Malayan Governments to facilitate the merger of Singapore with Malaya. The Malayan Federation changed its name to Malaysian Federation.”
The Petition, at the outset, points out that the UN did not address an earlier Memorandum on the issue, dated 9 Sept 1962, and signed by Sarawak United Peoples’ Party, United National Pasok Momogun Party North Borneo (Sabah) and Parti Rakyat Brunei.
In calling for a review on self-determination, the Petition deplores “the arbitrary and indecorous surrender of our sovereignty by the United Kingdom of Great Britain and Northern Ireland under Command of Her Majesty the Queen of England, to the Federation of Malaysia on 16th September 1963”.
The Petition notes without comment that this surrender of sovereignty “was without exercise of the right to self-determination in contravention of the spirit and letter of the United Nations and Decolonization Declaration adopted by the General Assembly Resolution 1514 (XV) of the 14th December 1960”.
Brunei attained independence, Sarawak and Sabah under ‘change of status’ stature
It’s this right, self-determination, which the organisers behind the Petition and signature campaign want to pursue in following up the Memorandum dated 9 Sept 1962.
“Whereas Brunei attained independence on 1st January 1984, Sarawak and Sabah have remained under ‘change of status’ stature without national independence up to today,” notes the Petition. “This has been documented as such in the United Nations Trusteeship Agreement listed by the General Assembly as Non-Self-Governing Territories.”
Besides BoPIM, other participating organisations include the Borneo Heritage Foundation headed by Jeffrey Kitingan, the Sarawak People’s Organisation headed by Lina Soo and Borneo Rights International headed by Kanul Gindol.

Group draws up self determination petition for Sarawak and Sabah
KUCHING: A coalition of NGOs, politicians and activists from Sarawak and Sabah have drawn up a petition recently, addressing it to the United Nations (UN) secretary-general to re-open the issue of self-determination for the two East Malaysian states.
The petition, touted to have been signed by some 100 representatives at a leading hotel in Miri last Saturday, was also copied to the UN Special Committee of 24 (C-24) and the UN Human Rights Committee. It aimed to gather several hundred thousand signatures in both states before making its way to the UN secretary-general.
A copy of the petition sent to The Borneo Post on Monday pointed out that the people of Sarawak, Sabah (then known as North Borneo) and Brunei as former British colonial subjects, first appealed to the UN by the Memorandum dated Sept 9, 1962.
Signed by Sarawak United Peoples’ Party, United National Pasok Mamogun Party and Parti Rakyat Brunei, the request however remained unaddressed by the UN owing to the intervention of historic events which recast the political course of Sarawak, Sabah and Brunei for the last 51 years.
“Whereas Brunei attained independence on 1st January 1984, Sarawak and Sabah have remained under ‘change of status’ stature without national independence up to today; documented as such in the United Nations Trusteeship Agreement listed by the General Assembly as Non-Self-Governing Territories,” the petition stated.
UK-based Borneo’s Plight in Malaysia (BoPIM) president Daniel John Jambun who sent the copy was reported in the media yesterday as saying that Sabah and Sarawak were dragged into the Malayan Federation on Sept 16, 1963 by the British and Malayan governments to facilitate the merger of Singapore with Malaya.
The Malayan Federation then changed its name to Malaysian Federation.
“It’s obvious from Article 160 of the Federal Constitution that Malaysia was not formed as was earlier promoted by the British and Malayan governments,” explained Daniel on why he signed the petition.
The petition, in calling for a review on self-determination, sought assistance from the UN to review “the arbitrary and indecorous surrender of our sovereignty by the United Kingdom of Great Britain and Northern Ireland under Command of Her Majesty The Queen of England, to the Federation of Malaysia on 16th September, 1963”.
It noted that this indecorous surrender of sovereignty was sanctioned by the UN “without exercise of the right to self-determination in contravention of the spirit and letter of the United Nations and Decolonisation Declaration adopted by the General Assembly Resolution 1514 (XV) of the 14th December 1960”.
The organisers behind this petition and signature campaign, in its pursuit to follow up on the memorandum dated Sept 9, 1962, requested at the earliest opportunity given to make representations before the UN to seek Sabah and Sarawak inherent right to self-determination as enshrined in the Charter of the United Nations.
“The right of self-determination of peoples is a fundamental principle in international law and this legal doctrine is also embodied in the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights,” the Petition said.
It is understood that the event, under the People’s Initiative of Sarawak and Sabah, is collaboration between Sarawak Association for Peoples’ Aspiration (SAPA) and Borneo Heritage Foundation (BHF) among others.

Negara-negara tersebut ialah Negara England, Negara Scotland, Negara Wales dan Negara Northern Ireland. Begitu jugalah yang seharusnya dan semestinya terjadi kepada persekutuan Malaysia.
Persekutuan Malaysia berlandaskan kepada konsep dan kefahaman asal iaitu ia sebenarnya HANYA terdiri daripada EMPAT buah Negara yang Merdeka dan Berdaulat; Negara North Borneo (kini dikenali sebagai Negara Sabah), Negara Sarawak, Negara Singapura (tetapi telah dikeluarkan daripada persekutuan oleh kerajaan Malaya) dan akhir sekali ialah persekutuan tanah melayu (malaya). Namun apa yang berlaku kini, konsep dan kefahaman asal telah diubah oleh seorang anggota dalam persekutuan Malaysia dengan niat yang jahat untuk menguasai atau dalam erti kata yang lain untuk menjajah anggota-anggota dalam persekutuan tersebut. Anggota tersebut ialah kerajaan persekutuan tanah melayu (malaya).

Jikalau anda berbangga mengatakan diri adalah Bangsa Negara Sabah dan Bangsa Negara Sarawak, sila dengan sepenuh jiwa, sertai perjuangan ini… Jadilah Pejuang Bangsa yang sejati… Bukan pangkat atau darjat yang menjadi perhitungan dalam konteks perjuangan ini tetapi sejauh mana kesungguhan anda untuk bersama-sama mengembalikan Hak Mutlak Kerajaan kita, Kuasa Kemerdekaan dan Kuasa Kedaulatan kita! Sudah 51 tahun lamanya kita telah ditipu dan ditindas, adakah kita mahu memberikan mereka 51 tahun lagi untuk menipu dan menindas kita semua? Suara anak-anak Bangsa kita yang kian membesar ini yang juga merupakan pelapis kepada kita, generasi masa depan kita kini bergantung sepenuhnya terhadap tindakan kita pada hari ini. Apakah kita akan disumpah celaka kerana berdiam dan bodoh tidak berbuat apa-apa untuk mereka ketika kita mempunyai tenaga yang kuat ataupun di kenang sebagai pejuang Bangsa yang dihormati selama-lamanya?
Semuanya kini terletak pada tindakan kita pada hari ini.

Jeffrey: Hari Malaysia adalah Hari Penjajahan
Malaya telah mengambil alih Sabah daripada British dan kini Malaya menjajah semula di bawah nama Kerajaan Persekutuan Malaysia.
KOTA KINABALU: Kerajaan Persekutuan boleh muflis tanpa sumbangan kewangan dari Sabah dan Sarawak.
Menurut ADUN Bingkor, Datuk Dr Jeffrey Kitingan, Sabah dan Sarawak harus dilayan sebagai rakan kongsi yang sama di Malaysia dan bukan sebagai negeri ke-12 dan ke-13 dalam Malaysia.
“Kerajaan Persekutuan mengambil masa 50 tahun, bagi mengiktiraf sebagai “Hari Malaysia,” katanya.
Beliau mendakwa Malaya telah mengambil alih Sabah daripada British dan kini Malaya menjajah semula kami di bawah nama Kerajaan Persekutuan Malaysia.
“Di manakah janji-janji “kebebasan mutlak, kemakmuran dan keselamatan?” soal Dr Jeffrey lagi.
Katanya lagi, Mereka (Malaya) mengawal sumber minyak dan gas kita, memungut hasil kita, menjalankan kerajaan kita dan sengaja mengubah demografi kami (melalui Projek IC , Ops Durian Buruk, pengundi hantu dan membuat miskin Sabah dan tidak selamat.
Beliau mendakwa sekarang Sabah hanya satu negeri “orang suruhan” Putrajaya.
“Sudah 50 tahun pembentukan Malaysia, namun tidak ada “Kemerdekaan” dan kebebasan untuk bercakap.
Sebaliknya, Sabah telah “dijajah” oleh Malaya segi politik, ekonomi dan sosial,” dakwanya lagi.
Beliau berkata jika Sabah dan Sarawak memilih untuk keluar daripada Malaysia mungkin kewangan kita jauh lebih baik, dengan hasil negeri melebihi RM40 bilion berbanding kepada RM3.7 bilion ketika ini.
“Sabah menyumbang RM18 bilion dan Sarawak RM40 bilion kepada Petronas pada 2012. Sabah dilaporkan telah menyumbang lagi RM24 bilion dalam cukai persekutuan manakala jabatan-jabatan persekutuan di Sabah seperti Imigresen, JPJ, Kastam dan lain-lain akan telah mengumpul berbilion lagi.
Dalam sektor swasta, banyak syarikat termasuk GLC seperti Sime Darby, Guthrie dan Felda, di Semenanjung terutama syarikat perladangan menjana berbilion-bilion keuntungan bersih dari Sabah dalam sumbangan cukai pendapatan mereka kepada kerajaan persekutuan,” katanya lagi.
Beliau mencadangkan supaya hak-hak istimewa dan autonomi Sabah dipulihkan semula.
Beliau menyeru agar Perdana Menteri Datuk Seri Najib Tun Razak mempertimbangkan pilihan ini jika dia mahu untuk menyelamatkan Malaya / Malaysia untuk tempoh 50 tahun akan datang.
Rakyat Sabah harus sedar
Ini membuktikan bahawa janji-janji kerajaan pusat untuk membangunkan luar bandar Sabah dengan kemudahan asas telah gagal.
KOTA KINABALU: Rakyat Sabah harus sedar bahawa RM18 billion sumber minyak Sabah disalurkan kepada Putrajaya tetapi rakyat Sabah masih ketinggalan dalam keperluan paip air dan tandas siram.
Menurut Ketua STAR Sabah, Datuk Dr Jeffrey Kitingan, menara kembar Petronas. monorel tidak mampu dibina tanpa sumbangan sumber minyak Sabah.
“Tetapi apa rakyat Sabah dapat setelah 50 tahun berada di dalam Malaysia sedangkan di Ranau sendiri masih tiada bekalan air paip dan tandas siram,” kata beliau mengulas kenyataan bekas menteri persekutuan, Tan Sri Ghani Gilong yang menceritakan pengalaman orang Sabah yang pertama kali berada di Kuala Lumpur pada tahun 1962 menikmati air paip dan tandas siram.
Dr Jeffrey yang juga ADUN Bingkor mendakwa ini membuktikan bahawa janji-janji kerajaan pusat untuk membangunkan luar bandar Sabah dengan kemudahan asas telah gagal.
Beliau sedih penduduk Ranau ada yang sudah meninggal dunia menunggu kemudahan paip air dan tandas siram.
“Perkara ini berlaku kerana Sabah dianggap sebagai tanah jajahan dan bukannya equal partner. Sumber kekayaan Sabah dirompak untuk membiayai pembangunan yang berat sebelah di Semenanjung,” dakwanya lagi.
Beliau juga hairan sejak BN memerintah Sabah pada tahun 1994, Sabah telah menjadi negeri yang miskin sedabgkan pada tahun 1970an Sabah adalah negeri yang kedua terkaya selepas Selangor.
“Kenyataan bahawa Sabah adalah negeri paling miskin bukanlah satu tuduhan pembangkang tetapi fakta yang dikeluarkan oleh Bank Dunia selepas penyelidikan yang mendalam,” katanya lagi.
Kerajaan Persekutuan mencuri hasil Sabah
Mereka sanggup mereka cerita dan memujuk pemimpin Sabah untuk menerima bayaran tunai sebanyak 5 peratus.
KOTA KINABALU: Pemimpin Malaysia tidak mempunyai asas undang-undang untuk menyatakan bahawa sumber minyak yang terletak di luar pantai Sabah adalah milik kerajaan persekutuan.
Menurut Ketua STAR Sabah, Datuk Dr Jeffrey Kitingan, pendedahan Tan Sri Majid Khan bahawa minyak hanya terdapat di pantai milik Sabah jelas membuktikan bahawa pemimpin persekutuan dari Malaya “mencuri” minyak dan sumber gas Sabah.
Katanya,mereka sanggup mereka cerita dan memujuk pemimpin Sabah untuk menerima bayaran tunai sebanyak 5 peratus.
“Apabila Tun Datu Mustapha dan Tun Fuad Stephens (gambar) enggan menandatangani perjanjian dengan Petronas maka kosnpirasi dibuat supaya berlakunya kemalangan kapalterbang yang dinaiki Fuad pada petang 6 Jun 1976,” dakwa beliau sebagai mengulas cerita terpendam yang dibentangkan oleh Majid Khan pada forum baru-baru ini “The Formation of Malaysia – The Untold Story” yang dianjurkan oleh Persatuan Sabah.
Majid turut menambah bahawa apa yang dikatakan benar atau sah adalah perkara yang lain dan ia terpulang kepada rakyat Sabah hadir untuk membawa perkara itu ke mahkamah untuk menentukan kesahihan itu.
Perlembagaan Persekutuan 1963 memperuntukkan bahawa wilayah Sabah sebagai wilayah yang terkandung di dalamnya sebaik sebelum Hari Malaysia pada 16 September 1963 merupakan sempadan antarabangsa 1954.
Petronas telah ditubuhkan pada tahun 1974, empat daripada 19 telaga minyak di Sabah dan Sarawak sudah mengeluarkan kira-kira 99,000 tong sehari.
Sumber petroleum di Sabah termasuk pelesenan dan pungutan royalti sebagai hasil Sabah datang dalam lingkungan Seksyen 24 Ordinan Tanah Sabah (Bab 68) yang telah diluluskan pada tahun 1930, dahulu sebelum pembentukan Malaysia.
Di bawah Perkara 74 Perlembagaan Persekutuan, perkara-perkara tanah yang termasuk sumber petroleum datang dalam kuasa Senarai Negeri dalam Jadual 9. Permit dan lesen untuk mencari gali untuk lombong, pajakan perlombongan dan sijil juga datang dalam lingkungan Senarai Negeri dalam Jadual 9.
Dr Jeffrey menegaskan bahawa Parlimen Malaysia tidak mempunyai hak menggubal undang-undang perniagaan Akta Pembangunan Petroleum (PDA) 1974 apabila perkara-perkara yang datang dalam lingkungan Senarai Negeri dalam Jadual 9.
“PDA adalah undang-undang perlembagaan tidak bernilai, namun, ia masih digunakan untuk menyedut kira 95% daripada minyak Sabah dan sumber gas sehingga hari ini tanpa bantahan daripada pemimpin-pemimpin BN Sabah,” katanya.
Katanya lagi, Allahyarham Tun Razak tidak mempunyai kuasa undang-undang dan tidak mempunyai bidang kuasa ke atas minyak dan gas di Sabah apabila beliau secara tidak sah dan menyalahi undang-undang yang ditandatangani Perintah Letak Hak pada 27 Mac 1975 pemberian minyak Sabah dan sumber gas kepada Petronas.
“Kehilangan royalti akan menjadi antara 12% hingga 30% jika angka yang diberikan oleh Tengku Razaleigh sebagai kayu pengukur untuk pergi. Royalti 30% kepada RM18 bilion yang dikutip oleh Petronas keseluruhan kepada kerajaan Sabah merupakan tambahan RM5.4 bilion dalam pendapatan tambahan pada tahun 2012 kepada RM3.7 bilion hasil bajet negeri dikumpulkan dalam negara.” tegas beliau.
Tambahnya lagi, seperti yang dinasihatkan oleh Majid, hari ini bola kini berada di kaki rakyat Sabah untuk mengambil isu pemilikan dan perkongsian hasil minyak Sabah dan sumber gas.
“Pemimpin BN Sabah tidak boleh diharapkan untuk meneruskan perkara itu terutama apabila Ketua Menteri telah memberikan petunjuk kepada pemimpin-pemimpin yang lain untuk berdiam diri apabila beliau berkata bahawa tidak ada semakan segera pembayaran minyak dari Petronas,” dakwanya lagi.
Debat untuk meraih populariti?
Hasil debat bukan boleh memajukan Sabah dan Sarawak, malah memecah belahkan masyarakat.
KUCHING: Pembentukan Malaysia mula diragui oleh warga Sabah dan Sarawak malah wujudnya kumpulan nasionalis menghangatkan lagi pentas politik negara.
Debat terbuka antara wakilKetua Menteri Sarawak iaitu Idris Buang, ahli tertinggi parti Pesaka Bumiputera Bersatu (PBB) dengan kumpulan aktivis facebook mendapat reaksi panas di laman sosial.
Ada yang memberi reaksi positif dan negatif mengenai debat terbuka tersebut.
“Hasil debat bukan boleh memajukan Sabah dan Sarawak, malah memecah belahkan masyarakat. Beliau boleh berdebat kerana beliau berkuasa,” ujar Sengapa Rembang, orang awam yang memberi pandangan mengenai isu ini.
“Jika beliau mahu berdebat, kita cabar beliau pergi bersemuka atau tolong kaum Penan di Murum, “Beliau cuma mahu tumpang populariti untuk menjadi calon pilihan raya negeri yang akan tiba tidak lama lagi,” tegas beliau
Seperti yang sedia maklum, laporan FMT kelmarin menyiarkan pencabar Idris iaitu penulis blog, pentadbir halaman dan kumpulan aktivis facebook seperti Sabah Sarawak Keluar Malaysia (SSKM), Sarawak Sovereignty Movement (SSM) dan The Future of Sabah/Sarawak serta Sabah Sarawak Federation (SSF).
Idris, dalam menerima cabaran melalui posting Facebook, berkata individu-individu dan kumpulan terbabit telah “menghasut rakyat Sabah dan Sarawak untuk merdeka dari Malaysia malah menyifatkan mereka sebagai ‘ancaman’.
Sementara itu, pentadbir halaman SSKM, Doris Jones, sebagai pengamal undang-undang di Britain menambah sebagai seorang yang bekerja di Mahkamah (contohnya Mahkamah keadilan untuk para legal) tidak akan berdebat melalui media sosial.
“Saya pernah terlibat dalam perdebatan awam secara langsung, tetapi pertamanya melalui kaedah-kaedah yang anda tahu dengan baik,
“Notis perlu diberikan terlebih dahulu kepada semua panel,
“Kita sebagai pentadbir di SSKM tidak hanya mahu meletakkan kumpulan kami sebagai persaingan kepada mana-mana kumpulan lain Borneo. Itu bukan dasar kami di semua.” tegas beliau
Seperti dalam laporan FMT, menteri-menteri di Sarawak pula berbelah bahagi dengan keputusan menyemak semula Perjanjian Malaysia.
Menteri Pembangunan Tanah, Datuk James Masing dipetik akhbar tempatan berkata, Persekutuan Malaysia dan kedudukan Sarawak harus dikaji semula.
Sementara itu, Timbalan Menteri Dalam Negeri, Datuk Wan Junaidi memberi amaran kepada pemimpin parti supaya jangan membangkitkan isu Perjanjian Malaysia.
Rising Borneo consciousness among S’wak bloggers
Sabah Star chairman Jeffrey Kitingan said the rise of political consciousness in Sarawak augured well for Borneo.
KUCHING: Over 50 bloggers here met with Sabah assemblyman Jeffrey Kitingan to brainstorm over existing issues affecting the two Borneo states.
Topping their discussions were the federal government’s defaults on the Malaysia Agreement and the insidious ‘amendments’ to the federal constitution and Malaya’s ‘occupation’ of Sabah and Sarawak’s natural resources.
Since the historic 2008 general election and the subsequent 2011 state elections in Sarawak, political awareness has seen an increasing presence in the blogsphere.
In the run-up to last May’s general elections, Kitingan was the voice Sarawakians heard brandishing the 20 and 18 points agreements involving Sabah and Sarawak.
Speaking to FMT here, Kitingan said the rise of political awareness in Sarawak especially among the younger generation was a sign of ‘emerging times’.
He said the emergence of new groups such as the Sabah Sarawak Movement (SSM), Sabah Sarawak Keluar Malaysia (SSKM), United Varsity Student of Borneo (UVSB) showed that the people of Sabah and Sarawak were desperately wanting to express their concerns.
Both SSM and SSKM are active on social media and have 7,742 and nearly 10,000 members respectively.
“It’s a sign of emerging times. People are beginning to question the state’s position as the 12th and 13th state in Malaysia when this is not the reality.
“That these questions are being asked indicates that we have a problem that needs to be addressed,” Kitingan said.
Amendments to federal constitution
He said in 1963 independent sovereigns Sabah and Sarawak went into partnership with the Federation of Malaya as equals.
“The Federation was formed through 20 points and 18 points conditions, among them were important promises to Sabah and Sarawak that they will be self-governing.
“As equal partners Sabah and Sarawak were assured that we will have the power to control our resources and finances and political franchise.
“But today it is no longer that and we find ourselves (Sabah and Sarawak) degraded to be just be one of state.
“It has been a project takeover for Malaya,” said Kitingan.
He pointed out that the federal constitution had been surreptitiously amended “around 1975 and 1976” to “totally change the concept of Malaysia”.
“The amendments turned Sabah and Sarawak into the 12th and 13th state. It was a takeover of British colonies.
“And now we are colonized by Malaya especially Sabah,” he said adding that Sarawak had managed to preserve its independence to some extend because of Chief Minister Taib Mahmud.
Senior leaders in the Taib-run administration have in recent months also openly accused the Umno-led federal authorities of shortchanging Borneo and have gone as far as to call for a review of the current situation.
Meanwhile Taib’s firm stand on the ‘status quo’ of the Malaysia Agreement and the state government’s endorsement of Sarawak’s Independence Day on July 23 last year augurs well for Borneo sentiments.
Orang Sarawak mengecam campur tangan luar
Tindakan membelakangkan Perjanjian Malaysia 1963 mengemukakan memorandum membantah Taib jadi TYT tidak wajar.
KUCHING: Rakyat Sarawak tidak menyokong campur tangan orang luar dalam hal ehwal politik di negeri itu.
Tindakan PAS dan PKR yang mengemukakan memorandum kepada Yang di Pertuan Agong dan Majlis Raja-raja (MRR) supaya menangguhkan perlantikan Tan Sri Abdul Taib Mahmud sebagai Tuan Yang di Pertua (TYT) yang baru mendapat reaksi negatif daripada orang ramai.
Aktivis Sabah Sarawak Keluar Malaysia (SSKM), Abdul Halim Hamdian menyifatkan tindakan Pakatan Rakyat (PR) seperti mengambil kesempatan menceroboh urusan pentadbiran negeri ini.
“Kalau betul PR benar-benar menyuarakan hak rakyat Sarawak, mereka perlu mempersoalkan kenapa gelaran ‘Yang Dipertua Negeri’ menggantikan istilah ‘Gabenor’?
“Tindakan mereka sedaya upaya membelakangkan hak perlembagaan yang termaktub dalam Perjanjian Malaysia 1963 dengan membawa Majlis Raja-raja untuk masuk campur dalam urusan pelantikan TYT yang baru,
“Mereka fikir taraf Gabenor Sarawak ini sama dengan YDP Pulau Pinang dan YDP Melaka dalam konteks ini?
Halim berkata tindakan luar biasa PR ini cuma untuk meraih populariti.
Sementara itu Sheldon Edgar berkata tindakan PR ini sebagai tindakan balas dendam menjatuhkan Taib.
“Kenapa tidak cari kesalahan menteri-menteri yang lain di Malaya (Malaysia) secara khusus dan kenapa perlu nak jaga tepi kain Sarawak?
“Selagi Taib masih memegang pucuk pimpinan, selagi itu mereka susah nak masuk Sarawak.” tegas beliau.
Idris Bin Wahhid pula menambah: “Apasal PAS sama PKR goyang jika Taib jadi TYT?”
Sementara itu, Agong dan MRR sehingga kini belum memberi apa-apa reaksi mengenai isu Taib.

Ulang tahun kemerdekaan Sarawak disambut meriah
Kerajaan masih belum ada cadangan mengisytiharkan 22 Julai sebagai cuti umum.
KUCHING: Sambutan perayaan ulang tahun ke 51 Sarawak merdeka daripada empayar British disambut meriah walaupun tiada sambutan seluruh negeri yang dilakukan oleh kerajaan negeri pada Selasa lepas.
Sambutan ulang tahun ke-51 tahun Sarawak merdeka dimulakan dengan “Sarawak Independent Walk” yang dianjurkan oleh Jawatankuasa 722 2014 pada 19 Julai dibawah Sarawak People’s Aspirations (SAPA) dan beberapa badan bukan kerajaan (NGO) turut hadir memberi sokongan serta sekitar 100 orang turut hadir.
Pada 20 Julai pula, acara yang sama turut dilakukan di Miri dibawah Hornbill Talks, halaman Facebook, dan disokong oleh syarikat persendirian. Sekitar 100 lebih peserta mengambil bahagian.
Sementara itu, pada 22 Julai Persatuan Graduan Melayu Sarawak (IGMS) juga mengadakan lakonan semula peristiwa bersejarah yang membawa Sarawak menjadi sebuah negara yang berdaulat dan membentuk kerajaan sendiri 51 tahun yang lalu.
Walaupun di sebalik kegemilangan dan majlis bagaimanapun, Presiden IGMS Anib Said bimbang kepentingan di sebalik peristiwa bersejarah yang telah disalahgunakan oleh orang luar untuk melanjutkan agenda politik mereka sendiri, ada yang termasuk pengembalian pemerintahan British dan Brooke.
“Kami tidak cuba untuk memaksa referendum ke atas Malaysia,” katanya kepada pemberita pagi ini.
Terdapat juga perarakan yang dilakukan pihak awam yang dikenali sebagai #PH227 sebuah gerakan awam yang mengadakan perarakan merdeka pada jam 10 pagi sehingga 12 tengah hari dan mereka juga turut menuntut kerajaan negeri mengisytiharkan 22 Julai sebagai cuti umum.
100 peserta lebih dilaporkan turut hadir memberi sokongan.
Penduduk di Bintulu juga turut mengadakan perarakan awam yang dilakukan pada sebelah malam dan sekitar 100 lebih juga peserta memberi sokongan.

Menteri Pembangunan Tanah, James Jemut Masing berkata buat masa ini kerajaan masih belum ada cadangan mengisytiharkan 22 Julai sebagai cuti umum.
Kerajaan negeri turut meraikannya sebagai sebuah acara rasmi kerajaan dengan Majlis Memperingati 22 Julai & Penghargaan Sambutan Perayaan 50 Tahun Sarawak Merdeka Dalam Malaysia pada malam Isnin.
Pada 22 Julai 1963, Sarawak telah diberi kemerdekaan oleh pihak British sebelum membentuk Persekutuan Malaysia pada 16 September 1963.

Terlebih dahulu, pihak SSKM ingin MENAFIKAN dan MENYANGKAL akan tindakan keterlibatan membakar bendera "malaysia/malaya" ini. Pembakaran bendera ini sebenarnya dilakukan oleh bangsa Filipina di Manila sebagai tunjuk perasaan menentang tindakan kerajaan "malaysia" semasa insiden pencerobohan pengganas di Tanduo, Lahad Datu Sabah.
Sesungguhnya pihak beritasemasa (Punca Ugutan Keras Tuntutan Facebook Sabah Sarawak Keluar Malaysia. Apa Kata Rakyat Malaysia?) ingin timbulkan prasangka negatif dan provokatif untuk mencemarkan imej pihak SSKM dalam usaha untuk mendidikan Bangsa Negara Sabah dan Bangsa Negara Sarawak tentang kebenaran yang selama ini disembunyikan oleh kerajaan persekutuan malaysia/malaya selama ini. Apa yang diperjuangkan oleh pihak SSKM adalah apa yang sebenarnya diinginkan oleh majoriti bangsa Negara Sabah dan Negara Sarawak.
Selama 51 tahun Bangsa Negara Sabah dan Bangsa Negara Sarawak memberikan peluang kepada pemimpin malaya untuk memperbetulkan keadaan namun, semakin diberi, semakin mereka menindas dan terus menipu. Perkara yang lebih menyedihkan apabila kerajaan malaya terus memperbodohkan diri tentang hak kesamarataan Negara Sabah dan Negara Sarawak dengan persekutuan tanah melayu/malaya. Mereka telah mengangkat diri mereka sebagai tuan kepada Kerajaan Negara Sabah dan Negara Sarawak. Dan ini sesuatu yang TIDAK BOLEH DIMAAFKAN!
Pihak SSKM berharap agar penyokong Kebangsaan Negara Sabah dan Kebangsaan Negara Sarawak tidak termakan penipuan yang cuba dilakukan oleh pihak beritasemasa melalui gambar tersebut. Point 7: Right of Secession
There should be no right to secede from the Federation.

We should take a positive view of the "no right to secede" initiative, which is worth considering despite its affirmation in Point 7 which speaks of the Sabahan and Sarawakian rights to secede from the Federation of Malaysia This is so because “the use [by Point 7] of the word ‘’should’ (as opposed to the word ‘shall,’ for example) turns the option of "NO RIGHT TO SECEDE" into a mere recommendation.”
You see.. Diplomatic documents often demand close linguistic analysis. Would that Point 7 have meant something else, had it said that “There SHALL be no right to secede from the Federation.”?
Since the auxiliary verbs “shall” and “shan’t” have all but disappeared from American English, in much of Great Britain they are still in common use. The facts that the 18/20 Points Agreement was an Agreement relating to Malaysia between United Kingdom of Great Britain and Northern Ireland, Federation of Malaya, North Borneo, Sarawak and Singapore, it’s British usage that counts — and when it comes to that, what greater authorities do we have than the estimable Fowler brothers, F.G. and H.W., whose “The King’s English” (first edition published by Oxford University Press, 1906) served generations of perplexed English speakers as a revered guide. Here’s what “The King’s English” (traditionally known as “Fowler”) has to say about “shall,” “should,” “will” and “would” in a discussion that is 20(!) pages long:
“It is unfortunate that the idiomatic use [of these words], while it comes by nature to southern Englishmen (who will find most of this section superfluous), is so complicated that those who are not to the manner born can hardly acquire it; and for them [this] section is in danger of being useless. In apology for the length of the remarks it must be said that the short and simple directions often given are worse than useless. The observant reader soon loses faith in them… and the unobservant is the victim of false security."
Needless to say, this is highly reassuring! Fowler then opens its discussion with the following short and simple directions: “Roughly speaking, should follows the same rules as shall, and would as will.”
In their pure form, Fowler continues, "shall" and "should" express command or obligation, whereaswill and would express intention or prediction, the difference between the two members of each pair being that the second is the conditional form of the first. Hence, “There SHALL be no right to secede from the Federation.” would indicate that Sabah & Sarawak is commanded NOT TO SECEDE FROM THE FEDERATION unconditionally, whereas “There SHOULD be no right to secede from the Federation.” indicates that this command is SUBJECT TO A CONDITION (or CONDITIONS) — in this case, presumably, that SABAHAN & SARAWAKIAN wish “to continue being part of the Federation”
Would such a reading of my argument, if it is the correct one, turn POINT 7 into a “mere recommendation” that SABAH & SARAWAK continue to be part of the Federation of Malaysia when there is no reasons/causes to trigger their need to SECEDE FROM THE FEDERATION?? If POINT 7 intends to say that SABAH & SARAWAK need not secede from the Federation unless it wants to, then it also intends to say that SABAH & SARAWAK need not continue to be part of the Federation of Malaysia unless it wants to — a construction of POINT 7 that would be rather bizarre, to say the least.
True, in practice, as opposed to theory, the difference between “shall” and “should” in British English is somewhat different: “shall” often expressing a COMMAND on the speaker’s part, and “should” merely a DESIRE, as in “You shall go to the doctor” vs. “You should go to the doctor.” And yet if we paraphrase POINT 7 as saying, “The Point 7 of the Agreement of Malaysia desires that Sabah & Sarawak not to secede from the Federation,” is this significantly better for Sabah & Sarawak? How big an improvement over flouting the POINT 7’s command would be flouting the POINT 7’s desire??
In short, if we take consideration of the above arguments on the reading of POINT 7, the FEDERATION OF MALAYSIA should politely be told in the king’s English, “No, thank you.. we SABAHAN & SARAWAKIAN wish to SECEDE from the Federation.”
